Dealing with the police
If the police ask you to provide a statement or answer questions, it is important to remember that you only have to provide your name and address. You can reply “no comment†in response to further questions. You do not have to provide any more information. If you do, it can be used against you in Court.
So, if you are contacted by the police, you should contact us before being interviewed so that we can advise you on whether or not to provide a “no comment†interview. In many cases it will be wise to make a “no comment†interview. You also do not have to go with the police anywhere, unless you are arrested and told what you are being charged with.
Because of the detrimental effect of a criminal conviction, it is important to contact a criminal lawyer at an early stage:
To advise you on how to deal with the police/authorities to ensure that your actions do not unnecessarily strengthen their case against you;
To ensure that, if you must plead guilty to any of the charges, every step is taken to “mitigate†or reduce the severity of the sentence imposed on you;
To negotiate on your behalf with the police/prosecution/authority:
To ensure that they have obtained and considered all relevant evidence,
To obtain copies of all evidence they intend to rely on, and
To discuss whether any or all charges should be withdrawn.
TBA Law will appear for you in the Seymour Magistrates Court, Broadmeadows Magistrates Court, Melbourne Magistrates Court, or enquire about other court locations.
